LEGAL NOTICE
The present information that you have just accessed for the purpose of consulting or purchasing products, regulates the General Terms & Conditions of Use of the Online Store of “Manuel Armando Reis Silva & Filhos Lda” (hereinafter, “MSilva”), headquartered at Rua do Mirante n.º 59 – Vilar dos Prazeres – 2490-748 Ourém, legal person and registered at the Commercial Registry Office of Ourém under number 503150681.
USE OF THE ONLINE STORE
The use of this online store grants you the status of a Customer and implies full and unreserved acceptance of all the provisions included in the General Terms & Conditions, and in the Privacy Policy, in force at each time you access the Online Store.
If you do not fully accept any of the established conditions, you should not access/use the online store.
MSilva reserves the right to change and update the General Terms & Conditions periodically and without prior notice to the Customer.
The processing of personal data carried out by MSilva complies with current legislation on data protection, namely Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons in the regarding the processing of personal data and the free movement of such data (“General Regulation on Data Protection”) and other applicable community and national legislation.
All information provided by the Customer must be accurate and true. The Customer has the obligation to update the information provided to MSilva, whenever it undergoes any changes. The Client is expressly responsible for any false or inaccurate declarations that he makes and for the damages that he causes to MSilva to third parties, with the information that he provides.
MSilva is the entity Responsible for the Processing of its Customers\' personal data, whose lawful basis for processing is the execution of this purchase and sale contract.
In case of violation of the General Terms & Conditions, MSilva reserves the right to exercise any and all legally foreseen action. In addition, it also reserves the right, at its discretion, to terminate access to or use of the online store, with or without notifying the Customer.
MSilva applies the appropriate and necessary technical and organizational security measures to ensure information security. However, the Customer is aware that the use of the online store may not be 100% secure, therefore, there is the possibility that the information sent/received may be intercepted by unauthorized parties, and this fact cannot be attributed to MSilva.
The contractual proposal contained in the online store is aimed only at people of legal age, the Customer accepting that it can only be used by users over eighteen years old and/or with full contractual capacity and who, therefore, can be responsible for the commitments resulting from the buy and sell.
ONLINE PURCHASE PROCEDURE
1st Step: Selection of items to include in your shopping cart (the price of which is indicated in Euros, including VAT at the legal rate in force).
The Customer hereby accepts and expressly acknowledges that:
- The images of the products presented in the online store are merely illustrative and the Customer must carefully and fully read the information on the essential characteristics of the articles, and, in case of doubt, contact the customer support line or go to the MSilva store, in order to obtain any additional information or details;
- MSilva will make every reasonable effort to include accurate and up-to-date information about the products available on the site;
- The prices of the items indicated in the online store correspond to the full amount to be paid by the Customer.
2nd Step: Registration / Filling in the Form
For the purpose of confirming his order, the Customer will have to fill in a form, in which he must indicate:
- Customer\'s full name/corporate name;
- Complete address, telephone contacts and e-mail addresses of the Customer;
- NIF/NIPC of the Client;
- Complete address for delivery of the order.
3rd Step - Confirmation of the items and services included in the shopping cart, Buyer Data and Billing and Payment Data
The Customer undertakes to carefully check the data contained in his order summary, confirming the items and services selected in the shopping cart, Customer and billing data, and at that time he must go back to the previous steps in order to proceed with the respective rectification if detect any inconsistency.
Payment for the order is made in euros and the Customer can choose one of the available methods and if the Customer chooses to pay by bank transfer, MSilva must confirm with the bank that the amount has been received.
MSilva will acknowledge receipt of the order by email sent to the email provided by the Customer.
The invoice will be sent or delivered upon collection or delivery of the purchased products.
DELIVERY MODALITIES:
- In-Store Purchase Survey
The customer may choose to pick up their purchase online at the headquarters of MSilva located at Rua do Mirante n.º 59 – Vilar dos Prazeres – 2490-748 Ourém without additional transport costs.
At the time of collection, the Customer must check all goods packed in the packaging, their quantity and condition.
In the event of detecting defects or damage to the products and/or in the event that they do not match your order, the Customer must identify the damage or defects.
- Home delivery of the purchase
The delivery service is carried out by carriers contracted for the purpose and the value of the shipping costs is added to the order.
In the event of unavailability of the products for delivery, MSilva shall inform the Customer, within a maximum period of 3 days from the knowledge of such unavailability, proceeding with the refund of the amounts paid, in case the Parties do not agree on a new delivery period.
If it is not possible to deliver the goods due to the Customer, the costs related to the second deliveries will be borne by the Customer. If, on the date and time agreed for the Delivery, the Customer is absent, the carrier will, whenever possible, leave a document proving his visit, in which he will request that the Customer contact the Customer Support service to schedule an appointment. new service provision date.
- DELIVERY VERIFICATION
Upon receipt, whether for In-Store Pickup or Home Delivery, the Customer must immediately check the condition of the purchased products, their quantity and condition. In the event of detecting defects or damage to the items and/or if the items do not match your order, the Customer must contact MSilva using the contacts provided in the online store (Monday to Friday: 10:00h-12:00h / 2:00 pm to 5:00 pm).
- EXCHANGES AND RETURNS
The customer may return / exchange any product within the legal deadlines for this purpose, however, if he wishes to collect it, he will bear the transport costs.
- CLAIMS
The Customer may direct any complaints to MSilva, through the contacts available on the contacts page or send them to its headquarters.
- APPLICABLE LEGISLATION
For any divergence arising in the contractual relations between the Parties, Portuguese legislation will apply. Any issue or dispute arising from the application, interpretation, integration or execution of this Agreement, when it cannot be resolved by agreement of the parties, will be submitted to the Portuguese courts. The consumer may also resort to Alternative Dispute Resolution Entities, available at www.consumidor.pt.
In the event of a consumer dispute, the consumer may resort to the network of consumer dispute arbitration centers authorized to pursue information, mediation and arbitration activities in consumer disputes.

- PRIVACY POLICY
Manuel Armando Reis Silva & Filhos Lda, collects the customer\'s personal data for the purpose of managing the customer account, billing, provision of information, as expressly authorized for this purpose, all under the terms indicated above and the legislation in force.
This information stems from the provisions of article 18 of Law 114/2015, of 8 September.
The Customer declares to know and fully and unreservedly accept these General Terms & Conditions for Online Purchase and Sale.
